Professor of UnB and PhD in Commercial Law, Ana Frazão, teaches course on contractual practices at ESA/OAB-GO

A aula será ministrada às 9h no Auditório Eli Alves Forte – Sede OAB – Rua 1121, nº200, Setor Marista, Goiânia – GO.

Latin America's largest intellectual property event debates vertical restrictions on competition on online platforms

Discussion took place on XXXVII ABPI International Intellectual Property Congress in Rio de Janeiro

The dynamic reality of the online universe requires an increasingly strong and current debate on the functioning of market competition. A current example on the subject was the recent punishment applied by the European Commission to Google, of 2.42 billion euros, for understanding that the company abuses the dominant position in the search market favoring its own price comparison product. "In this case there are problems of both horizontal and vertical competition, impacting companies that do not compete directly with Google in the search market, but can compete with it in other segments. Is the discussion to what extent is that a legitimate attitude or is that an infringement? To what extent does Google not act as a gateway?", explains doctor in commercial law Ana Frazão.

To further deepen this discussion, the jurist participated on Tuesday (22) of the Intellectual Property panel and Vertical Restrictions to Competition in Online Platforms, at the XXXVII International Congress of Intellectual Property. The event promoted by the Brazilian Intellectual Property Association (ABPI) is the largest in Latin America on the subject and brings together about 700 participants, among industry experts, entrepreneurs, magistrates, consultants, lawyers, government authorities, and leaders of international entities such as the American Intellectual Property Association (AIPLA) and the Asociación Interamericana de la Propiedad Intellectual (ASIP).

"Competition law" book rescues dialogue with constitutional principles of economic order

Legal work Ana Frazon rescues dialogue with constitutional principles of the economic order

Jurists, economists and students have a new source of study on market economy: the book Competition Law – Presupposed and Perspective, by the doctor in Commercial Law Ana Frazão. The work will be published by the publisher Saraiva and launched on August 23 in the Cultural Space of the Superior Court of Justice (STJ).

Former counsellor of CADE, lawyer Ana Frazon addresses competition in the context of the relations of Law, Economics and Policy; the control of corporate structures and the control of conducts practiced in the business universe.

In seven chapters distributed over 512 pages, the book brings the author's critical and multidisciplinary perspective focusing on the subject didactics and basic notions of the area, as well as paths to the "deconstitutionalization" of Competition Law in Brazil. It also deals with the achievement of the expected objectives of a market economy in which the free-initiative and the pursuit of social justice are in constant tension, presenting the debate on issues that are in vogue, such as compliance and joint ventures.

The publication also highlights the legal framework of the illicit antitrust and presents specific aspects of the matter considering the impact of competition on the proper allocation of social goods.

In the preface, the jurist Calixto Solomon Son, sheds light on the need for structural reforms to ensure a real transformation in the fight against the abuse of economic power and points to the systematization of Ana Frazon as a coherent way of seeing the matter in current issues in a way relevant to the development of antitrust.
